RE: The tariff classification of men’s pants from Pakistan.

Dear Mr. Price:

In your letter, which was dated October 24, 2008, you requested a tariff classification ruling. As requested, your sample will be returned.

Style 43903 is a pair of men’s lounge pants constructed from 100% cotton, yarn dyed flannel fabric. The pants have a tunnel elastic waistband with an outside drawstring, a fly front opening with a single button closure, side seam pockets, and hemmed legs.

You describe Style 43903 as a sleepwear/loungewear separate bottom for wear to bed or in the residence and you have provided sales sheets which identify the garment as a lounge pant. Garments of this style are considered multi-use garments. The presence of the button on the fly provides sufficient closure for wear in variety of situations in and around the home. As such, they are not classified in heading 6207 which is limited to garments that are designed for wear only to bed for sleeping.

Consequently, the applicable subheading for Style 43903 will be will be 6203.42.4016, Harmonized Tariff Schedule of the United States (HTUS), which provides for men’s or boys’…trousers, bib and brace overalls, breeches and shorts: of cotton: other: other: other: trousers and breeches: men’s: other. The duty rate is 16.6% ad valorem.

Style 43903 falls within textile category designation 347. With the exception of certain products of China, quota/visa requirements are no longer applicable for merchandise which is the product of World Trade Organization (WTO) member countries. The textile category number above applies to merchandise produced in non-WTO member-countries. This ruling is being issued under the provisions of Part 177 of the Customs Regulations (19 C.F.R. 177).
